Mrs. Diezani Alison-Madueke, a former Minister of Petroleum Resources, has asked Justice Nichola Oweibo of the Federal High Court in Lagos to order the Economic and Financial Crimes Commission (EFCC) to release her $40million worth of jewellery and iPhone.
The Ex-minister who severed in the administration of Ex-President Goodluck Jonathan accused the anti-graft of invading her apartment and taking her properties illegally without court order or fair hearing from her. She said the order by the court to seize her properties was prejudicial.
According to Diezani who’s based in the United Kingdom since the emergence of the President Muhammadu Buhari led government, the EFCC violated her fundamental right to own property and to appropriate them at her discretion under sections 43 and 44 of the 1999 Constitution.
Diezani in her application through her lawyer, Awa Kalu (SAN), noted that the court lacked jurisdiction to have granted the interim forfeiture order of her properties in the first place as she was not charged or convicted for any crime.
Court had granted an order for the temporary forfeiture of the jewellery and iPhone to the Federal Government after the EFCC alleged that it suspected that they were acquired with proceeds of unlawful activities.
The anti-graft noted that Diezani does not have a provable lawful income to have acquired the $40million worth jewellery and iPhone.
