The Supreme Court has declared Governor Gboyega Oyetola as the winner of the Osun State Governorship Election held on September 22 and 27, 2018 (the main election was held on Sept. 22, while a supplementary election was held on Sept. 27).
The apex court upheld the judgement of the Court of Appeal which cancelled the ruling of the Osun State Election Petitions Tribunal.
Senator Ademola Adeleke, the candidate of the Peoples Democratic Party (PDP) in the election, had challenged the victory of Governor Oyetola who is the candidate of the ruling All Progressives Congress (APC) in the poll.
The Tribunal in a split judgement had declared Adeleke the winner of the election and had order the Independent National Electoral Commission (INEC) to issue the PDP candidate a certificate of return.
Oyetola however challenged the verdict of the Tribunal at the Court of Appeal.
In its ruling, the Appeal Court in a split judgment (four to one) declared that Peter Obiora, the judge who had read the majority judgment at the Tribunal, was absent on February 6 during the hearing at the Tribunal. Naija Buzz News published the judgement of the Court of Appeal which nullified the judgement of the Tribunal and upheld the victory of the governor.
The Supreme Court consequently noted that the absent of Mr. Obiora meant that the Tribunal lacked the authorities to have given any judgement on the case.
Five of the Seven-man Supreme Court judges nullified the judgement of the Tribunal and upheld the ruling of the Appeal Court.
Two judges however disagreed with the ruling which was read by Justice Bode Rhodes-Vivour.
