Atiku gives more reason why Justice Bulkachuwa should be disqualified from the PEPT

Former Vice President Atiku Abubakar, the Presidential Candidate of the opposition Peoples Democratic Party (PDP), in what appears to be more evidences why Justice Zainab Bulkachuwa should withdraw from the Presidential Election Petitions Tribunal revealed that the son of the Appeal Court judge campaigned for President Muhammadu Buhari.

Atiku noted that Aliyu Haidar Abubakar, the son of Justice Bulkachuwa, not only campaigned for Buhari ahead of the February 23 presidential election, but also contested the All Progressives Congress (APC) governorship primary election in Gombe State.

He further stated that Abubakar is a card-carrying member of the APC.

Justice Bulkachuwa from Gombe State is the President of the Court of Appeal and the head of the Presidential Election Petitions Tribunal. The PDP had demanded for her withdrawal from the tribunal because of her intimate relationship with her husband, Adamu Bulkachuwa, who is an APC senator-elect.

The party noted that it was impossible for her not to have discussed the presidential election petition with her husband who is a chieftain of the APC, adding that her judgment if allowed to be part of the tribunal could be biased.

Atiku through his legal team on Friday attached as exhibit the printout of Abubakar’s Facebook page showing his campaign posts and posters canvassing votes for Buhari ahead of the February poll.

Atiku and PDP consequently insisted on the disqualification of Justice Bulkachuwa as a member of the tribunal and the appointment of another justice as a replacement.

The Appeal Court President had on Wednesday following a meeting with the representatives of petitioner and the respondents requested that the PDP and Atiku presented their demand for her withdrawal officially since the matter was already in public domain.

The opposition party in its affidavit said; “I know that as a spouse of  Adamu Bulkachuwa,  Justice Zainab  Bulkachuwa is so closely related to Adamu Bulkachuwa that she cannot fairly hear and determine the instant petition without eliciting the suspicion and anxiety of all right thinking persons, including myself.

“The Court of Appeal has more than 80 justices who are able and competent to participate in the hearing and determination of the extant petition in the absence of  Justice Zainab Bulkachuwa.

“I also know that her biological son, Aliyu Haidar Abubakar is a card-carrying member of the 3rd respondent (APC) and he contested the governorship  primary election of the 3rd respondent  in Gombe State.

“Attached hereto and marked Exhibit 2 is a printout made today from the Facebook page named Aliyu Haidar Abubakar Volunteer Group containing his campaign posters, photographs and various posts showing his campaign messages for himself and the 2nd respondent, both of whom contested on the platform of the 3rd respondent.

“I also attach hereto and marked Exhibit 3 a printout of a Daily Post online news publication in which Aliyu  Abubakar was prominently featured as the son of  Justice Zainab Bulkachuwa and who contested the governorship primary  of Gombe State on the platform of the 3rd respondent.”

Atiku is the presidential candidate of the PDP, while Buhari is the presidential candidate of the APC.

The Independent National Electoral Commission (INEC) had declared President Buhari of the APC winner of the presidential poll, but Atiku of the PDP however vehemently rejected the result declared by INEC.

According to Atiku, he won the election with over 1.6million votes based on the results obtained from the computer server of the electoral commission.

INEC had however since denied Atiku’s alleged result, saying that they are false because it never transmitted results electronically to any server.
